Mt. Olive Township Council Minutes
December 21, 2004

The Special Public Meeting of the Mount Olive Township Council was called to Order at 7:00 pm by Council President Rattner with the Pledge of Allegiance.

MOMENT OF REFLECTION, especially in this case of the situation that happened today where we lost approximately twenty soldiers in one attack.

OPEN PUBLIC MEETINGS ACT ANNOUNCEMENT

According to the Open Public Meetings Act, adequate notice of this meeting has been given to the Mount Olive Chronicle. Notice has been posted at the Municipal Building, 204 Flanders-Drakestown Road, Mount Olive Township, New Jersey and notices were sent to those requesting the same.

ROLL CALL Present: Mr. Mund, Mr. Buell, Mr. Guenther, Mr. Perkins, Mr. Greenbaum,
Mr. Rattner, Ms. Labow (7:20)

President Rattner: We haven’t heard from Ms. Labow, so I expect her momentarily.

ALSO PRESENT: Mayor De La Roche; Bob Casey, Acting Business Administrator; Sherry Jenkins, CFO;
John Dorsey, Township Attorney; Lisa Lashway, Township Clerk.

President Rattner: With that, the first item we have on the agenda is the reason why we are meeting at 7:00pm at the Executive Session, to talk about status of Tax Appeals and the Kyle Conti contract. Can I get a motion to go into Closed Session?

Mr. Mund: So moved.

Mr. Perkins: Second.

President Rattner: Any discussion? Roll Call.

ROLL CALL Passed Unanimously

President Rattner: At the conclusion of the …..no, we’re going to leave, you can stay, we’re leaving. The one person from the public, because we don’t want to disrupt the one person, but we will be coming….when we come out, we will be going into a Special Public Session, because we hope to be able to take some public votes on what we’re discussing in Closed Session. Then we will go into our Workshop. With that, we’ll see you in a little bit.

Back in Session at 7:31 pm.

CONSENT RESOLUTIONS AGENDA:

Resolutions on the Consent Agenda List are considered to be routine and non-controversial by the Township Council and will be approved by one motion (one vote). There will be no separate discussion or debate on each of these resolutions except for the possibility of brief clarifying statements that may be offered. If one or more Council member requests, any individual resolution on the Consent Agenda may be removed from the Consent Agenda List and acted on separately.

CONSENT RESOLUTIONS

1. Resolution of the Township Council of the Township of Mount Olive RE: Deltronic Crystal Industries Tax Appeal.

2. Resolution of the Township Council of the Township of Mount Olive in Connection with the Tax Appeal of Seiko Corporation.

3. Resolution of the Township Council of the Township of Mount Olive RE: Givaudan Roure Corp., Tax Appeal, 2004/2005

4. Resolution of the Township Council of the Township of Mount Olive Resolving Outstanding Issues in Connection with Kyle Conti’s Contract Vis-à-vis Turkey Brook Park.

President Rattner: The first item we have on the agenda is our Special Public Meeting to take action on what we discussed in Closed Session. Everybody on the Council, we have four Resolutions, we went over them in Closed Session, everybody is satisfied, this is what was discussed. With that, I’ll ask Mr. Buell to move Resolutions 1 through 4.

Mr. Buell: I move Resolutions 1 through 4.

Mr. Perkins: Second.

PUBLIC PORTION ON CONSENT RESOLUTIONS

President Rattner: Is there anybody from the public who would like to address anything on these Consent Resolutions. This is the only official action we will be taking tonight. Seeing none, I’ll close the public portion.

President Rattner: Is there any Council comments?

ROLL CALL Passed Unanimously

PUBLIC PORTION

President Rattner: Now, because it’s a public meeting, we will have a public portion. Is there anyone from the public who would like to address the Council at this time? Seeing none, I’ll close the public portion.

COUNCIL COMMENTS

President Rattner: I will dispense, because it’s just….we have it on our regular public meeting, Council comments. Does anybody have a problem if I don’t ask for Council comments? Does anybody have any Council comments they would like to make at this time? Seeing none, we’ll get a chance on new business with the Workshop.

President Rattner: With that, I’ll take a motion to adjourn to our Workshop.

Mr. Perkins: So moved.

Mr. Greenbaum: Second

All were in favor and the meeting adjourned to the Workshop at 7:33 pm.
