Mount Olive Township Council Minutes
July 10, 2001

The Special Meeting of the Mount Olive Township Council was called to order at 7:30pm by Council President Rattner with the Pledge of Allegiance to the Flag.

According to the Open Public Meetings Act, adequate Notice of this Meeting has been given to the Mt. Olive Chronicle and the Morristown Daily Record. Notice has been posted at in the Municipal Building, 204 Flanders-Drakestown Road, Mt. Olive, New Jersey, and notices were sent to those requesting the same.

ROLL CALL: Present: Mr. Sohl, Mrs. Kelly, Mr. Scapicchio,

President Rattner

Absent: Mr. Heymann, Mr. Guenther, Mr. Spino

President Rattner: Mr. Spino, I’ve been advised had a death of a close relative in his family; Mr. Heymann may be here a little bit later—he has a commitment with one of our recreational activities; and Mr. Guenther is representing us at an MUA meeting. I would also like to acknowledge the attendance of the Mayor, Paul Licitra; the Business Administrator, Sandy Kaplan; the Townsihp Attorney, Bob Fisher; Township Clerk, Lisa Lashway; Director of Public Works, Mark DiGennaro; Special Projects Coordinator, Bob Casey; Grants Coordinator, Kathy Murphy; and from our Library Board, the President of the Board of Trustees, Jane Israel and the Township Librarian, Rita Hilpert. We have three Resolutions for tonight’s meeting that are going to be considered.

RESOLUTIONS B NON CONSENT

1. Resolution of the Mt. Olive Township Council Supporting A Letter of Intent to be Submitted by the Mt. Olive Township Library Board to the State of New Jersey as Part of a Grant Process for Additional Construction Funds.

Mr. Scapicchio moved for approval of the Resolution and Mr. Sohl seconded the motion.

Mr. Scapicchio: I will read this Resolution and Letter of Intent into the Record.

WHEREAS, the Mount Olive Township Council has already approved a capital budget for construction of a new library in the amount of $3,500.000.00 as part of the 2001 budget; and

WHEREAS, the Mount Olive Township Library Board has requested that the Township Council support its Letter of Intent to b submitted to the State of New Jersey as part of the grant process for additional construction funds; and

WHEREAS, the Mount Olive Township Council has reviewed and discussed this request of the Mount Olive Township Library Board and the Council wishes to give its full support to the Library Board with regard to the grant process for construction funds to the State of New Jersey.

NOW, THEREFOR, BE IT RESOLVED, that the Mount Olive Township Council hereby confirms its support of the attached Letter of Intent to be submitted by the Mount Olive Township Library Board to the State of New Jersey for a grant for additional construction funds and a copy of said Letter of Intent is attached to this resolution and incorporated in this resolution by reference.

--and the Letter of Intent is as follows:

The Mayor and the Township Council of the Township of Mt. Olive are in support of the construction of a new facility for the Mt. Olive Township Council Public Library. On January 7, 2001, Mayor Paul Licitra presented his proposal, his proposed budget for the Year 2001, and included in the Capital Budget portion $3.5 million for the construction of a new Library Building. On May 8, 2001, the Township Council voted to accept the Capital Budget for the Library in the amount of $3.5 million. These funds are to be used for the construction stage of the project as the Library Board has already provided the funds for the architectural fees. During the past several months, members of the Library Board and Township Council met as a Subcommittee to discuss the funding for the new

Library in the Building. On July 10, 2001, the Township Council voted—

Mr. Scapicchio (cont’d): --that’s tonight, hopefully we will vote—

--to appropriate additional funding in the amount of $500,000.00 for the new construction bringing the total contribution by the Township Council to $4,000,000.00.

In applying for this grant the Library Board and the Township Council move forward in their efforts to provide the residents of Mount Olive Township with a quality building that will address the needs of our residents.

--and the purpose of this additional $500,000 funding on the part of the Township is that that will help maximize the contribution that we can possibly get from the State. With that, we have Rita Hilpert and Jane Israel in the audience, and if you would like to make a comment, you’re welcome to.

Mrs. Jane Israel, President of Mt. Olive Library Board: I was going to thank you for voting “Yes” but you didn’t vote yet. So, I’ll just stand up here and urge you to vote “Yes” for this additional half million dollars. You know the architect presented the plans to you and he’s working now to get the schematics all ready to put in for the Grant. We do have a deadline of July 31, and Kathy Murphy is also working with us on that. We are going to do a good job for you, and I know that the people in Mt. Olive will appreciate it very much. Thank you very much.

President Rattner: Is there anyone from the Public who would like to address this Resolution? Seeing none, I will close the Public Portion. Any Council discussion?

Mr. Sohl: I think it would be worthwhile adding just one additional sentence—and I roughed it out—to point out—at the end of the first paragraph of the Letter of Intent we add something to effect that “additionally, the Township has already funded ‘x’ amount of dollars and purchased ‘n’ amount of acres of land for this project.” And that’s additional money that we ought to let the State know has “A” been expended. So, it adds to the contribution we’ve already put on the table.

President Rattner: I think it also shows that we’re ready to go too. Good point, Bill.

Mr. Scapicchio: Do we need to add that sentence now?

Mr. Fisher: Well, the Resolution can stand as drafted because it references the Letter of Intent, and what we’ll do, we’ll add that sentence—we’ll either—the Clerk’s Office, or our Office can redo the Letter of Intent because it also had been a blank space in the dollar amount, but the $500,000 was indicated on the Record.

Mr. Scapicchio: It was in there—this is the copy that had been revised. This is the copy that we have—it’s different than what you have.

Mr. Fisher: Oh, okay. Well, we can add that sentence so that it is attached to the Resolution. The amount of acreage, does anybody know that figure off hand?

Mrs. Kelly: 16 acres.

President Rattner: Yes, but we didn’t allocate 16 acres for the Library.

Mr. Fisher: All right, so we can just put a general content that the Township Council has already acquired Title to the land on which the Library will be constructed, and the other funds that you appropriated—

Mr. Sohl: We paid for that—

Mr. Fisher: Okay, that’s fine. It’s on the Record and it will be file in to the letter which will be attached to the Resolution.

President Rattner: Any other comments? Roll Call.

1. Resolution of the Township Council of the Township of Mount Olive Renewing the Plenary Retail Consumption License of Michael D. Kevil License Number 1427-33-019-004.

Mr. Scapicchio moved for approval of the Resolution and Mr. Sohl seconded the motion.

President Rattner: Is there anyone from the Public who would like to address this Resolution? Seeing none, I will close the Public Comments. Council Comments?

ROLL CALL: Passed unanimously

2. Resolution of the Township Council of the Township of Mt. Olive Authorizing the Execution of a Developer’s Agreement Between the Township and Musconetcong Masonic Temple.

Mrs. Kelly moved for approval of the Resolution and Mr. Sohl seconded the motion.

President Rattner: Is there anyone from the Public who would like to address this Resolution? Seeing none, I will close the Public Comments. Council Comments?

Mrs. Kelly: I noticed that the revised one that we received just changed the word “developer” in to “owner” is there significance between calling it the “developer” and “owner” because I guess it’s already built? It’s people that own it rather than the developer?

Mr. Scapicchio: I think that the developer is different than the owner. I think the developer is AIG Baker—isn’t that the remediation or the work they’re doing?

Mrs. Kelly: They put the conditions in which I think tightens it up, but they changed in each of the “WHEREAS’s” instead of calling it the “developer” they called it the “owner” and I was wondering if it was significant, why it was done that way?

Mr. Scapicchio: The owner and the developer are different.

Mrs. Kelly: Yes. I would think so.

President Rattner: But our Agreement is with the Musconetcong Lodge.

Mrs. Kelly: Yes, it’s with the Lodge, so it’s already a constructed building, so I guess it would be with the owner rather than the developer, correct?

Mr. Fisher: I think Mr. Scapicchio is correct. I was not familiar with this one, and I didn’t get a chance to talk with Mr. Dorsey, but, the Musconetcong Masonic Temple is the Party to this Agreement, and they are, in fact, the owner and did get site plan stage and approval stage. The actual developer—so, this is just an agreement with the owner now.

Mrs. Kelly: Okay. I just wanted to clarify that. Thank you.

President Rattner: Any other comments? Roll Call.

President Rattner: Okay, that finishes our Agenda. Unless there are any final Council Comments? None? Okay, we will Adjourn this Public Meeting and then go directly in to our Workshop Meeting for this evening.
